The purpose of these Terms and Conditions of Use is to set out the terms for using and browsing the Extended Monaco website.

The user confirms that he/she has read and understood these Terms and Conditions in their entirety before using any of the services offered by this website, and undertakes to comply with them.

The following words and phrases, beginning with a capital letter, whether used in the singular or plural, are employed herein with the meanings specified below:

WEBSITE PURPOSE

The purpose of the Extended Monaco website is to provide information regarding the latest developments in the #ExtendedMonaco programme, the Principality of Monaco’s digital transition programme.

The Extended Monaco website allows Users to receive a newsletter containing the latest news about the Principality’s Extended Monaco programme.

 

WEBSITE ACCESS

The Extended Monaco website requires access to a sufficiently fast internet connection and equipment and resources enabling Users to access and browse the website at their own discretion, responsibility and expense.

The Administration may not be held liable for poor functioning of the Services and any consequences thereof that result from a malfunction or limited or degraded internet access.

In the event that access to the Services is interrupted or unavailable, Users may contact the Administration for more information.

The Services must not be used in an abusive or malicious way.

Generally speaking, Users undertake to use the Services:

  • in compliance with the laws, regulations and rights of third parties, in particular the Administration’s intellectual property rights, as set out in intellectual property article;
  • fairly and in accordance with their intended purpose;
  • at their own risk.

Users are prohibited from fraudulently accessing or continuing to visit all or part of the Extended Monaco website, deleting or changing the information included on the Extended Monaco website, fraudulently adding information to the website, altering the Extended Monaco website, or interfering with the proper functioning of the website.

Users undertake to access and use the Extended Monaco website via a secure connection or network. Any use, representation, transformation, reproduction, adaptation or dissemination, in whole or in part, of any element or content from this website on any media and via any procedure is prohibited and constitutes a criminal offence that will be punished by the Monaco courts, unless express permission is obtained from the Administration.

Trademarks and/or logos belonging to the Administration and appearing on this website are protected trademarks under application legislation in Monaco. Any reproduction of these trademarks and/or logos, in whole or in part, without the permission of the owner, is a criminal offence punishable by the Monaco courts.

 

LIABILITY

Users acknowledge and accept that, with regard to the Extended Monaco website and Services, the Administration may not be held liable in the event of hacking, alteration or misuse of data, or any use of the network by a third party that is unlawful or harmful to the User or to a third party. The Administration makes no guarantee, express or implied, regarding the operation of this website and may not under any circumstances be held liable for any damage, whether direct or indirect, commercial or otherwise, or consequences that may result from an erroneous or obsolete publication that may appear on this website.

The Administration shall endeavour to ensure that the information published on this website remains accurate and up-to-date, but accepts no responsibility for any use made of information featured on the Extended Monaco website.

PROTECTION OF PERSONAL DATA

In accordance with current regulations on the protection of personal data, information gathered via the Extended Monaco website is collected by the State of Monaco/Digital Transition Office (Place de la Visitation – 98000 MONACO), hereinafter referred to as “the Administration”, which acts as the data controller.

Personal data is processed for the purposes of “Managing the Extended Monaco website”, which can be broken down as follows (or processing functionality):

  • Allow navigation (cookies);
  • Allow people to submit their ideas and express their satisfaction (feedback form);
  • Allow people to contact the Administration;
  • Allow information on the Extended Monaco programme to be published;
  • Allow a newsletter to be sent;
  • Produce statistics.

The processing of data for “Managing the Extended Monaco website” is part of the Administration’s role (Digital Transition Office). It is justified by:

  • The consent of the individual concerned;
  • The pursuit of a legitimate interest on the part of the Administration: allowing the Administration to promote and disseminate information about its Extended Monaco digital programme.

This information is retained only for as long as is required for the purposes cited above, notably:

  • As part of the feedback form: the information collected is not kept on the website and only for 12 months on the messaging system;
  • For sending out the Extended Monaco newsletter: until the user unsubscribes;
  • As part of cookies: maximum of 13 months.

Information processed as part of the Extended Monaco website’s functionality is for the Administration (Digital Transition Office) and is never used for commercial or advertising communications.

The recipients of personal data are:

  • Specially accredited staff working for the Administration as operator of the Extended Monaco website;
  • Accredited staff working for the hosting provider as part of its role in hosting and providing security for the website;
  • Accredited staff working for the email service provider as part of sending out the Extended Monaco newsletter;
  • Accredited staff working for the website developer as part of its role in maintaining and upgrading the newsletter system.

Given the use of analytics cookies, it is anticipated that your technical data (e.g. your IP address) will be transferred to the United States, a country which does not offer sufficient protection. The operation of certain cookies involves the communication of technical data to bodies located in the United States (Google Analytics). The creation of hyperlinks to this website or the referral to other external websites via this website are subject to prior approval from the Administration. The Administration reserves the right to request removal of all existing links which contravene this condition.

The Extended Monaco website may contain hyperlinks to external websites. The Administration does not control these websites and may not under any circumstances be held liable in any way for the content published on these external websites.

The Administration may not be held responsible for any damage or losses that may result from or be connected with the use of these external websites. Users of this website bear full responsibility for and assume the risks of using these external websites. The Administration may not be held liable in any way.

Should a link lead the User to encounter unlawful content which infringes current legislation, the User should cease browsing the site concerned to avoid incurring the sanctions stipulated under the legislation that applies in Monaco and facing legal action. COMPETENT JURISDICTION

Any dispute related to the use of the Extended Monaco website shall be subject to Monegasque law, and the Monegasque courts shall have exclusive competence.
